The Sunshine Act: Public Disclosure of Income Earned from Industry Relationships
Beginning in March 2013, under a section of the recently enacted 2010 Patient Protection and Affordable Care Act, manufacturers of drugs and medical devices and Group Purchasing Organizations will be required to report to the Secretary of Health and Human Services (HHS) payments and transfers of value made in any amount to physicians and teaching hospitals. Certain ownership interests held by physicians in these companies must also be reported. "Physician" is defined in the new law to include dentists and others engaged in certain medical specialty areas. HHS is required to report the payments made and equity interests held on a publicly accessible website no later than September 2013. Read more.
